Heard Ms.Sultana Sonawane, learned counsel for the petitioner and Ms.Dipti Kuber, learned counsel for the respondent, at length.

By this Petition under Section 11 of the Arbitration and Conciliation Act, 1996 (for short, 'Act'), the petitioner has prayed for appointment of Mr. U.A. Patel, Advocate to act as sole arbitrator for resolving the disputes between the parties.

By order dated 12.6.2017, this Court proposed to appoint Hon'ble Mr. Justice R.Y. Ganoo (Retired), a former Judge of this Court, as 1 / 2

The proposed Arbitrator was requested to submit statement of disclosure in terms of Section 11(8) and 12(1) as also to state whether he was in a position to make award within a period of 12 months from the date of arbitral Tribunal entering upon the reference under Section 29-A of the Act.

In terms of the order passed by this Court, the learned prospective Arbitrator has submitted the statement of disclosure under Section 11(8) read with Section 12(1) of the Act as also has stated that he will be in a position to devote sufficient time for arbitration and he will be able to complete the entire arbitration within a period of twelve months from the date of arbitral Tribunal entering upon the reference. The statement of disclosure submitted by the prospective Arbitrator on 20.6.2017 is taken on record and marked 'X' collectively, for identification.

In view thereof, the Petition is disposed of by appointing Hon'ble Mr. Justice R.Y. Ganoo (Retired), a former Judge of this Court, as a Sole Arbitrator for resolving the disputes between the parties. Learned Counsel for the parties assure that they will serve copy of this order on the learned Arbitrator. Order accordingly.
