Heard. This is an application under Section 438 of Cr.P.C. The applicant herein is apprehending his arrest in C.R. No.237 of 2015 registered at Jodbhavi Police Station, Solapur, for the offences punishable under Sections 143, 149, 323, 324, 327 of IPC.

It is the case of prosecution that on 22.12.2014, Ganesh Patole lodged a report at the police station alleging therein that on that day at about 7 p.m., he had been to meet his friend Vaibhav Kagre. On the way, he had met Sonya Gajdhane who asked him as to who abused the boys from Gujar Vasti. The complainant had feigned ignorance. At that time he was assaulted on his head

Mhi 2 by one person. Sonya had assaulted him with fighter on his face and had mounted assault upon him with fist and kick blows. He had informed Swapnil Sarwade about the same. Swapnil Sarwade had come to the spot. They had asked Swapnil to come to the police station.

Today, perused the papers and seen the injury certificate. The injury certificate indicates that injured Swapnil had sustained only a blunt trauma. The nature injury was simple. There are no criminal antecedents. In view of this, the applicant has made out a case for grant of pre-arrest bail. 4.

The observations made hereinabove are prima facie in nature and the Sessions Court shall not be influenced by the above observations while deciding the application for quashing of FIR, discharge application or at the time of trial.

(i) In the event of arrest, the applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount. (ii) The applicant shall report to the concerned police station on four
