M. S. SONAK, J.

DATE : 30 JANUARY 2017.

P.C. :- 1] Despite several opportunities, no steps are being taken to effect service upon respondent Nos.1 and 3 whose presence is necessary for deciding this appeal. Every time, either the Registrar (Judicial-II) or this court has been adjourning the matter in order to enable the applicant to take steps. However, every time, it is noticed that no steps are being taken. Even today, as if, as a matter of routine, learned counsel for the applicant seeks for some time. 2] This is a matter of 2008 and already, several opportunities have been granted. Therefore, no further indulgence is possible in a situation of this nature. The civil application for condonation of delay is dismissed for non-prosecution. Consequently, the first appeal as also the application for stay are also dismissed for non prosecution.
