Learned counsel for the petitioners and the respondents state that the parties have amicably settled their dispute. Learned counsel have tendered a Consent Terms entered into between the petitioners and the respondents. The said Consent Terms are taken on record and marked `X' for identification.

Both the petitioners are present and accept the Consent Terms and the undertakings given therein by them. The respondent No. 1 is present for himself and as sole mutawalli (trustee) of respondent No. 2. Mr. Mohiuddin Ahmed Abdul Hamid Ansari, Director of the respondent No. 3 SQ Pathan 1/2

wp.9682.16.1.doc is also present. The said respondents also agree and undertake to abide by the Consent Terms entered into by them with the petitioners. Self attested identifications of the petitioners and the respondents, are taken on record. By the said Consent Terms, both, the petitioners and the respondents have undertaken to fulfill their promise as mentioned in the Consent Terms. The petitioners have agreed and undertaken to this Court that they will withdraw the proceedings mentioned in Clause (vi) on page 7 of the Consent Terms, subject to receiving the amounts mentioned in the said Consent Terms.

In short, all parties have agreed to comply with their respective undertakings, as set out in the Consent Terms. The undertakings given by the parties are accepted as undertakings given to this Court. Accordingly there shall be an order in terms of the Consent Terms. Petition is disposed of accordingly.
