The learned counsel appearing for the Petitioner informed this Court that the charge is already framed by the trial court. From the perusal of the pleadings and grounds taken in the petition and reliefs claimed therein, we find that all these grievances can be raised before the learned Judge of the trial court who is seized with the matter.

At this stage the learned counsel appearing for the Petitioner on instructions seeks permission to withdraw this Petition with liberty to raise the grievances before the trial court.

We dispose of this writ petition as withdrawn with the following observations :- lgc

(30) cri.wp-792.21.odt (A) Liberty is granted to the Petitioner to raise the grievances before the concerned trial court by way of filing appropriate application/proceeding.

(B) In case such application/proceeding is filed by the Petitioner, the concerned trial Court to consider the said application/proceeding at the appropriate stage and pass the appropriate orders in accordance with law. (C) We made the aforesaid observations without prejudice to the contentions of the Respondents and their right to contest the said application/proceeding.
