The learned counsel for Respondents informs that the suit has been dismissed for default and application for restoration is filed. As on date the suit stands dismissed. Accordingly the impugned order dated 8 January 2014, passed by the learned District Judge, Sangli in the Miscellaneous Civil Appeal No.109 of 2012 also does not survive. Therefore, the Petition has become infructuous as there is no injunction against the Petitioner. In case the suit is restored and order of injunction is revived, liberty to the Petitioner to take out appropriate proceedings. Writ Petition is accordingly disposed. (N.M.Jamdar, J.)
