Learned APP on instructions submits that the police have filed charge-sheet as against 3 accused(except the Petitioner) in M.E.C.R. No. 1 of 2019, registered with the Khar Police Station, Mumbai, for the alleged offences punishable under section 420 and 120(B) of the Indian Penal Code.

Learned APP has tendered a report of the Senior 1/3

P.I. of Khar Police Station, Mumbai dated 15/11/2022. The same is taken on record.

From a perusal of the said report, it appears that since there was no evidence found as against the petitioner, charge-sheet has not been filed against him.

Learned APP submits that the police will be filing a report under section 169 of the Cr. P.C., as against the Petitioner, at the earliest. Statement accepted. 5.

In view of the report and what is stated by the learned APP, nothing survives for further consideration in the aforesaid Petition, which is filed by the Petitioner for quashing of the aforesaid M.E.C.R. registered as against him.

Needless to state, that we have not heard the Petition on merits and as such, all contentions of the parties 2/3

are kept open.

Needless to also state, if any order is passed which is prejudicial to the Petitioner, the Petitioner is always at liberty to file a fresh application/petition. 8.

The Writ Petition is disposed of on the above terms.
