Heard the learned Counsel for the applicants. The applicants herein happen to be the original owner and the title holder of the premises situated at 21, Prabha Mandir, P. Balu Marg, Prabhadevi, Mumbai 400 025. The original title deeds in 1/3
respect of the said premises are in the custody of the respondent No.
2. The applicants herein desires to execute a gift deed to her grandson in respect of the said property. The grand-son of the applicants who happens to be a practising lawyer Mr. Akhil Sarathi is voluntarily giving an undertaking that he requires the said premises for personal use and would continue to retain the said premises for himself. He would not create any third party interests in respect of the said premises. He would give an undertaking to that effect before this Court as well as before the Additional Chief Metropolitan Magistrate, 47th Court, Esplanade, Mumbai. Copy of the said undertaking will also be given to the respondent No. 2.
The grand-son of the applicants Mr. Akhil Sarathy shall give an undertaking that during the pendency of the trial or any other proceedings in respect of the said property he will not create third party interests in respect of the said premises and will not change the title of the premises without prior permission of this Court. The 2/3
original gift deed executed by the applicants in favour of her grandson shall be given to the respondent No. 2. In view of this, the Petition stands dismissed as withdrawn and disposed of with the above directions.
