By this petition filed under Article 226 of the Constitution of India, the petitioner seeks to impugn the order dated 18th November 2006 passed by the Civil Judge, Senior Division, Pune directing the petitioner to pay Rs.10,000/- per month to the respondent-wife as maintenance form the date of filing of the application filed under Section 24 of the Hindu Marriage Act.

I have heard the learned counsel appearing for the parties and have perused the records.

It is not in dispute that the petitioner was directed to pay a separate maintenance by the JMFC in the sum of Rs.10,000/- to the wife and Rs.5,000/- to the two of the children. Though the petitioner has filed an appeal against the said order passed by the JMFC, and though there is no stay, the petitioner has not paid arrears of maintenance of the entire amount till date. The petitioner has not paid any amount in so far as this case is concerned.

After hearing the learned counsel for the parties, perusing the record and perusing the observations made by the learned Trial Judge in the impugned order, I am of the view that there is no infirmity in the order passed by the learned Trial Judge and does not warrant any interference in the order of maintenance of Rs.10,000/- passed by the learned Trial Judge. The amount awarded by the learned JMFC is fair and reasonable. The writ petition is accordingly dismissed. No order as to costs.
