By this civil application, the applicant seeks condonation of delay of 1 year and 21 days in filing civil application and for restoration of the Second Appeal No.341 of 2013 which is dismissed for non-compliance of the conditional order passed by this court on 21st December, 2013. Mr.Nargolkar, learned counsel appearing for the applicant submits that the private paper book in the second appeal has been already filed however belatedly. Delay in filing private paper book is condoned. Order dated 21st December,2013 passed by this court is recalled. Second Appeal No. 341 of 2013 is restored to file. Civil application is disposed of in the aforesaid terms. No order as to costs. 2.

Hearing of the Second Appeal No.341 of 2013 is expedited. It is made clear that interim order operating on the date of the order passed by this court while admitting the second appeal is also restored. [R.D. DHANUKA, J.]
