By an order passed yesterday i.e. on 17/2/2015 in the above Civil Application the status quo which was granted vide order dated 13/1/2015 has been continued till today i.e. 18/2/2015. The above Civil Application has been filed for continuation of the order of status quo which has been granted vide the said order dated 13/1/2015 in view of the fact that the two Notices of Motion which were directed to be disposed of by the said order dated 13/1/2015 have not been so disposed of by the City Civil Court (Borivali Division), Dindoshi. It appears that the said Notices of Motion have been transferred for hearing from Court Room No.6 to Court Room No.8 of the City Civil Court, (Borivali Division), Dindoshi, and were listed yesterday i.e. on 17/2/2015 but could not be proceeded with as the learned counsel appearing lgc

caw-416.15 for the Applicants i.e. the original Plaintiffs was in this Court pursuing the above Civil Application. The status quo was granted by this Court so as to protect the structure of the Applicants pending the decision in the Notices of Motion which they have filed in the suit.

The learned counsel for the parties state that the said Notices of Motion are now listed on 23/2/2015. This Court had issued a direction that the Notices of Motion be disposed of as expeditiously as possible and latest by 17/2/2015, however, in view of the change in the Court that has not been possible. However, the Court to which the Notices of Motion have now been assigned i.e. Court Room No.8 and before which the Notices of Motion are now listed on 23/2/2015 is directed to dispose of the same latest by 10/03/2015. The order of status quo to continue up to 11/03/2015. The Trial Court to see to it that no unnecessary adjournments are granted. It is expected that the learned counsel appearing for the different parties co-operate with the Trial Court in the disposal of the Notices of Motion within the aforesaid time.
