SB.920.WP.587.2013
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.587 OF 2013 Amit Rajendra Javheri and others Petitioners versus The State of Maharashtra and another Respondents Mr.A.P.Kulkarni, Advocate for Petitioners - Absent. Dr.F.R.Shaikh, APP, for State.
Mr.J.S.Yadav i/by Mr.Vilas B. Tapkir for Respondent no.2. CORAM :
S.C.DHARMADHIKARI AND PRAKASH D. NAIK, JJ.
DATE :
12th April 2017 PC :
The Petitioners and their Advocate, both are absent. From the record it is clear that an ad-interim order was passed on 22nd February 2013. The same has continued and the matter was never listed before the Court after 22nd April 2013. In the meanwhile, we find that an incomplete copy of first information report has been annexed. It is only the first page of the same which sets out the columns and which are duly filled in but without the statement of the complainant. Meaning thereby that copy of the FIR has not been annexed. Today when there is no compliance of the procedural requirements and Petitioners & their advocate, both are absent when their names are correctly displayed on board, we dismiss the application for want of prosecution. Ad-interim relief granted on 22nd February 2013 is vacated. (PRAKASH D. NAIK, J.) (S.C.DHARMADHIKARI, J.) MST
