That Petitioner No.1 has not been indicted as accused in the said crime. 2) As the police have already filed charge-sheet against Petitioner No.2, learned Advocate for the Petitioners, on instructions, seeks leave to withdraw the Petition with liberty to file an Application for discharge, if 1/2

Leave and liberty granted.
