This application is for restoration of Second Appeal no. 283 of 2012 which was dismissed for want of prosecution by order dated 15.01.2014 passed by this Court.

The learned counsel for the applicant submits that they already deposited the cost of Rs.1000/-. The statement is accepted.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the 1/3

Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Order dated 15.01.2014 passed by this court is recalled.

b) Second Appeal no. 283 of 2012 with Civil Application no. 492 of 2012 is restored on file for hearing on its own merits.

c) Civil application stands disposed off accordingly.
