Learned Advocate for the petitioner, on instructions, states that during pendency of the present writ petition, the petitioner negotiated One Time Settlement scheme with respondent No.3 / Bank. According to him, the amount as per One Time Settlement scheme has been paid to the Bank. Therefore, the present writ petition is rendered as infructuous.

Hence, the impugned order does not survive. However, if it is found that the amount of One Time Settlement scheme is not paid or the statement recorded above is incorrect, it will be open
