The petitioner, party-in-person, submits that he tried to fill the nomination paper through Internet but as the Internet connection failed, he could not submit the nomination paper. Thereafter the petitioner personally approached the Returning Officer, who refused to accept nomination paper as there was no alternate arrangement made in case of failure of Internet. The petitioner has submitted a representation to State Election Commission on 4/2/2017. He has also submitted an application to the Returning Officer on 6/2/2017 at 2 p.m.

Mr. Shetye, learned counsel appearing for the State Election Commission submits that as on today there is no alternate arrangement made in case of failure of Internet. The Commission is contemplating solution on such issues. Learned counsel submits that in some cases due to fault, technical error some people could not fill nomination paper in the State.

We direct the State Election Commission to look into such issues and try to resolve it in future. The petitioner is entitled to resort to appropriate alternate remedy after the election results are declared. 4.
