Learned Counsel for the Respondent No.1 states that the petitioner has filed an Appeal before the Sessions Court and that the same is pending and therefore, the aforesaid writ petition is not maintainable. 2.

In view of the aforesaid, learned counsel for the petitioner seeks leave to withdraw this petition with liberty to pursue his remedy before the Sessions Court.
