Mr. A.A. Garge, learned counsel for the Respondent points out that in all probabilities, this Petition has been rendered infructuous since the challenge was to the order dated 23rd December, 2005 below Exhibit 7 by which the Appeal Court had refused to stay the decree made by the trial Court, pending Appeal. He submits that since Appeal is of 2005, in all probabilities, the same must have been disposed of.

Accepting the aforesaid statement and even otherwise neither the Petitioner nor his advocate are present, this Petition is dismissed for want of prosecution.

The interim order if any, to stand vacated.
