By this petition under Article 227 of the Constitution of India, the petitioner has challenged the order dated 22.1.2015 passed by the learned Judge, Family Court No.5, Mumbai below Exhibit-46 in Petition No.E-123 of 2009. By that order,

2/2 CriWP/652/2015 the Family Court rejected the application made by the petitioner for re-examination of the petitioner.

After arguing the petition for some time, Mr. Chandulal states that he will not press this petition and states that he will take out fresh application for reexamination of the petitioner.

In view thereof, the Petition is disposed of as not pressed with liberty to the petitioner to take out application for re-examination of the petitioner. If such application is taken out, all contentions of the respondent including maintainability of such application are kept open.

5.

The grant of liberty shall not be construed as any expression on merits of maintainability or otherwise of such application. Order accordingly.
