This application seeks modification of order dated 18 th October, 2016 seeking deletion of direction to deposit Rs.25 lakhs failing which the stay that has been operating in their favour would stand vacated. It appears from the records that on 20 th February, 2017 also time was taken to deposit the amount and it was extended upto 27 th February, 2017.

There after on 3 rd March,2017 leave was sought to carry out amendment to the application to annexe copy of the appeal memo filed before the Sessions Court. Leave was granted. This amendment is also not been carried out till date. 3.

Today learned Counsel appearing for the applicant prays for further time to deposit Rs. 25 lakhs. He submits that all the applicants are Senior citizens and 1/2

5-apl-183-2017.odt applicant no. 3 is bed ridden. On behalf of the applicant they seek some accommodation in terms of time to deposit. He stated on instructions from applicant no.2 who is present in Court that within six weeks from today he will deposit the sum of Rs. 25 lakhs. In the circumstances time to deposit the sum of Rs. 25 lakhs is extended till 2 nd August, 2017.

In the event of failure to deposit the said amount before the learned Sessions Court, this application shall stand dismissed without further reference to the Court. In the circumstances, parties shall act on the authenticated copy of this order.
