1] The learned counsel for the applicant submitted that though the police have submitted final report in the present crime on 19th December 2016, they are still conducting further investigation as contemplated under Section 173(8) of the Cr. P.C. He submitted that there is every possibility, the police may submit supplementary chargesheet. He therefore on instructions seeks leave to withdraw the present application with liberty to file fresh application for bail before the Trial Court, if police submits supplementary chargesheet after completion of further investigation. 2] Leave and liberty granted.

3] The application is dismissed as withdrawn with aforesaid liberty. 4] It is needless to mention that this Court has not examined the merits of the present application.
