After arguing at length learned Counsel for the applicants upon instructions seeks liberty to withdraw the applications with further liberty to appear before the concerned Magistrate. The liberty as prayed for is granted in the interest of justice. The applicants shall appear before the concerned Magistrate on or before 23/2/2018. The learned Magistrate shall consider application on its own merits without being influenced by the withdrawal of this application. The learned Magistrate shall consider the applications of applicant No. 2 in ABA 263/18 and applicant in ABA 264/18 with the aid of proviso to Section 437 of the Code of Criminal Procedure, 1973. In view of this, the applicants stand protected till 5 p.m. of 23/2/2018. The applications stand dismissed as withdrawn and disposed of accordingly.
