The applicant is apprehending his arrest in connection with C.R.No.19 of 2021 registered with Aarey Police Station, Mumbai, for ofences under Sections 385, 120(B) read with 34 of Indian Penal Code ("IPC", for short). Digitally signed by RajeP. Aher Date:

Aher The First Information Report ("FIR", for short) is registered by Raiees Ansari on 15th January 2021. The complainant had applied for permission for renovation of house. Work was going on. The case of the complainant is
rpa 2/4 10 aba 452 2021.doc that, the accused No.1 Nilesh Dhuri had threatened him and demanded an amount Rs.1 Lakh to stop complaints and demolition of his house. The complainant gave him Rs.1 lakh. In March 2020, Nilesh Dhuri, Dawood Shaikh and applicant sent person named Narvekar to tell him that complaint about illegal construction of his house has been made. The complainant inquired from Aarey administration and learnt about complaint by one Narvekar. He was pursuing complaint with support of applicant and others. Nilesh Dhuri was their leader. On 10th January 2021, complainant met Nilesh Dhuri and Dawood Shaikh. Nilesh demanded Rs.2 Lakhs to protect his house and Rs.20,000/- be given to Narvekar. Nilesh demanded Rs.10,000/- to be parted till 15th January 2021. Hence, complaint was lodged. It is apparent that the complainant has not stated anywhere that the applicant had approached him and threatened him or demanded the amount.
Learned APP submitted that applicant is part of the group. Others were threatening the complainant.
rpa 3/4 10 aba 452 2021.doc Investigation is in progress. It is also pointed out that Nilesh Dhuri and Dawood Shaikh are arrested and they are released on bail.
Applicant was granted interim protection by order dated 24th February, 2021. Considering the factual aspects, the applicant need not be subjected to custodial interrogation. Hence, I pass the following order:
:: O R D E R ::
(i) Anticipatory Bail Application No.452 of 2021, is allowed;
(ii) The interim order dated 24th February, 2021, is confirmed;
(iii) In the event of arrest of the applicant in connection with C.R.No.19 of 2021, registered with Aarey Police Station, Mumbai, the applicant be released on bail on executing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount;
rpa 4/4 10 aba 452 2021.doc (iii) Applicant shall report the investigating oficer, as and when called for, till filling of the charge-sheet; (iv) Anticipatory Bail Application No.452 of 2021, stands disposed of accordingly.
