1] Heard learned counsel for the petitioners and respondent. 2] By this petition, the petitioners are challenging the order dated 18.11.2017, passed by the City Civil Court, Mumbai, thereby disposing off the Summons for Judgment No.216 of 2016, directing the petitioners to deposit the principal amount of Rs.15,87,881/- in the Court, within two months from the date of order, alongwith written statement.
3] The only submission advanced by learned counsel for the petitioners is that the petitioners are unable to raise this amount of Rs.15,87,881/- despite the efforts made by them and therefore, the 1/2
910 WP 2843 OF 2018.odt said amount may be reduced taking a sympathetic view of the matter. Only by way of indulgence, in order that the matter should be decided on merits, this Court is inclined to reduce the amount of Rs.15,87,881/- to Rs.10,00,000/- to be deposited by the petitioners within a month from the date of this order alongwith the written statement as directed by the trial Court.
4] No further extension shall be granted .
5] On failure to deposit the aforesaid sum within the stipulated period, the order passed by this Court shall stand vacated. 6] Writ Petition is disposed of in above terms.
