Heard the petitioner in person who states that she is advocate practicing in this Court. Yesterday when the matter was heard for some time we had requested her to take advise and assistance from colleague advocate.

Considering the fact that custody of the body was being claimed we issue notice and made it returnable today only. 3.

Learned APP appears for Respondent No.1 to 3. There is no report of service upon other respondents.

Report dated 8/2/2019 sent by Senior Police Inspector, Amboli Police Station, Mumbai to office of Public Prosecutor shows that police upon inquiry found that the deceased had a real brother by name Arun Dhundiraj Pingle. The said brother and grand son of that brother viz., Abhishek reported to the Police Station on 3/2/2019 and as requested by

rsk 2/2 905-WP-668-19.doc them the body of the deceased was delivered in their possession. The petitioner also was claiming to be adopted daughter of deceased but she could not produce any document to substantiate her claim. 5.

In this situation, we find that the urgency which prompted this Court to take cognizance of the matter has ceased to exist. We take the copy of report received by office of learned APP on record as Exhibit A. Copy shall be given by learned APP to the petitioner also. 6.

Keeping all contentions of the petitioner open, we dispose of the present matter.
