Mr. Zubin Kamdin, on instructions, states that though this writ petition has been admitted by this Court, the petitioner has instructed through their Advocates to seek leave of this Court to withdraw the writ petition with liberty to approach the concerned District Magistrate with a fresh application under Section 14(1) and (1A) of the Securitisation and Reconstruction of Financial Assets and Enforcement of

This application for withdrawal was orally made in the morning session. We granted permission to produce the papers but with notice to other side.

Since the writ petition is being sought to be withdrawn with this liberty, none has any objection to this course. The writ petition is disposed of as withdrawn with the liberty as prayed for.

We clarify that we have not examined the legal contentions of both sides and they have been kept open for being decided at an appropriate stage.
