The Applicant, apprehending his arrest, in connection with the investigation of Crime No.566 of 2021 registered with Pimpri Police Station, Dist. Pune under Section 307, 504, 506 read with Section 34 of I.P.C. and Section 37(1) read with Section 135 of the Maharashtra Police Act and Section 4 and 25 of the Arms Act, is seeking pre-arrest bail.

The aforesaid offence is registered on the basis of the complaint lodged by Mohd. Nambilal Bandgi Shaikh on 28.08.2021. The incident is alleged to have happened on 28.08.2021 at about 12 noon in which the Applicant and the coaccused are alleged to have assaulted the first informant. Sneha Chavan page 1 of 3

I have heard the learned counsel for the parties. Perused record.

Perusal of the FIR prima facie shows that the allegation about assault by a sickle is made against Sumit Sasane, who is the brother of the Applicant. Insofar as the present Applicant Sajan Sasane is concerned, the allegation is that he had assaulted the first informant by a cement block lying on the road on his head. The incident is alleged to have happened on the spur of moment, when co-accused Sumit Sasane accosted as to why he (first informant) is staring at him.

The injury report shows a single contused lacerated wound (CLW) on the occipital region. The investigation of this case is complete and the chargesheet is filed. Out of 4 accused, except this Applicant all others are released on bail. The learned counsel for the Applicant states that there are no criminal antecedents to the discredit to the Applicant.

Hence, the following order:
ORDER
i) In the event of his arrest, in connection with the investigation of Crime No.566 of 2021 registered with Pimpri Police Station, Dist. Pune, the Applicant shall be released on bail on executing a PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

ii) The applicant shall report to the Investigating Officer on 20 and 21 February 2022 between 11.00 a.m. to 1.00 p.m. and as and when required by the Investigating Officer. iii) The applicant shall co-operate with the Investigating Agency and shall not tamper with the prosecution evidence/witnesses.

The criminal application is disposed of in the aforesaid terms.
