Learned counsel for the parties submit that the question involved in this petition has already been considered and decided by this Court in the case of Jyoti Prakash Chougule Vs. State of Maharashtra and others1. It is also stated that thereafter various Division Benches of this Court as well as of Nagpur Bench have considered the issue and have reiterated the view taken in the case of Jyoti Prakash Chougule (supra).

In view of the aforesaid submissions, we dispose of this petition in the light of the order passed in case of Jyoti Prakash Chougule (supra). The directions contained in the said order shall apply to this case also. As a consequence, impugned order dated 6th Writ Petition No.2354 of 2012 decided on 7th January 2014
