It is seen that address of Respondent No.1 is same as per Lower Court order. The Notice issued to Respondent No.1 is returned unserved with remark "Not found personally and room found locked". Respondent No.1 was Opponent No.1 in the proceedings before the Motor Accident Claims Tribunal, Satara, and he was absent before Tribunal. Hence, it is evident that Respondent No.1 cannot be served by regular mode of service. There is no other way to serve Respondent No.1 except by way of substitute service as mentioned in prayer clause of Civil Application.
In view of this, Civil Application is allowed in terms of prayer clause (a). Issue substitute service Notice to Respondent No.1.
