The applicant was arrested on 22.05.2019 in connection with C.R. No.I-188 of 2019 registered with Shil Diaghar Police Station for the offence under Sections 370 (1) (2) read with 34 of IPC and Sections 4, 5, of Immoral Traffic (Prevention) Act. 2.
The case of the prosecution is that on receipt of the information, raid was conducted. Applicant and her husband were arrested. The statements of two victims were recorded. On completing investigation, charge-sheet was filed. 3.
Learned counsel for the applicant submitted that the applicant is a lady. Her husband is released on bail. She is in
Ethape 2 48.ABA.609.2020 custody for a period of two years. There are no criminal antecedents against the applicant. Section 370 is not attracted. Both the victims rescued were major. 4.
Learned APP submitted that the applicant has played role in the crime. She was involved in prostitution activity. 5.
The applicant is in custody since last two years. The statements of the victims were recorded. They are major. The husband of the applicant is granted bail. Statements of victims do not indicate that they were forced into alleged act or exploited by applicant.
Considering the aforesaid circumstances, further detention of the applicant is not necessary. Hence, the following order: -
ORDER
(i) Bail Application No.609 of 2020, is allowed;
(ii) The applicant is directed to be released on bail in connection with C.R. No.I-188 of 2019 registered with Shil Diaghar Police Station on furnishing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount;
Ethape 3 48.ABA.609.2020 (iii) The applicant shall report Shil Diaghar Police Station, once in three months on first Saturday of the month between 11:00 a.m. to 01:00 p.m. till further orders;
(iv) The applicant is permitted to furnish provisional cash bail in the sum of Rs.25,000/- for a period of 8 weeks in lieu of sureties;
(v) Bail Application stands disposed of accordingly. (PRAKASH D. NAIK, J.)
