Neither the appellant nor his advocates are present. Ms.More appears for the respondent­Municipal Corporation of Greater Mumbai (MCGM). She points out that the suit structure, in respect of which, interim relief has been declined by the learned Trial Judge is on the Corporation property, which has been reserved as a recreation ground.

Accordingly, the Appeal From Order is dismissed for non­prosecution. In view of the dismissal of the Appeal From Order, the Civil application does not survive and the same is also disposed of.
