1] Heard the learned Counsel for the applicant and learned Counsel for the respondent- claimant.

2] This civil application is for condonation of delay of 47 days in filing First Appeal, challenging the judgement and award dated 7th July 2012 passed by the Motor Accidents Claim Tribunal in Claim Application No.456 of 2006.

3] Considering the submissions made by the learned Counsel for

YBG caf1583-13 the applicant and the averments made in the application, I am satisfied that the applicant has made out a case for allowing the application. Hence, civil application is allowed in terms of prayer clause (a) which reads thus:- "(a) the delay of 47 days be condoned"

(b) Civil application disposed of.
