The Applicant is seeking regular bail in Crime No. 281 of 2018 for an offence punishable under Sections 302, 307, 143, 145, 147, 148, 149 of Indian Penal Code and Section 3(25) of Arms Act. On 28th September 2018 Applicant came to be arrested. 2.

The only evidence available on record against the Applicant is statement of Sopan Santosh Patne. In the statement of this witness under Section 164 of the Code of Criminal Procedure, he alleged that the Applicant has assaulted him with one Shivaji Pawar. There is no medical

2/2 Yadav 18.ba.461.19 evidence or injury certificate to that effect on record. As such, the involvement of the Applicant is under doubt.

That being so, present Application deserves to be allowed. Hence, the following order.

ORDER

(A) The Applicant be released on bail in Crime No. 281 of 2018 for an offence punishable under Sections 302, 307, 143, 145, 147, 148, 149 of Indian Penal Code and Section 3(25) of Arms Act on executing PR Bond of Rs.25,000/- with one or more sureties in the like amount.

(B) The Applicant shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.
