This Application is moved for restoration of Civil Application (St.) No. 13357 of 2017, which was dismissed pursuant to the conditional order dated 22.09.2017 passed by the I/c. Registrar (Judicial-II).

The learned Senior Advocate for the applicant submits that the First Appeal was admitted on 03.03.2006, however, it was

Trupti p518-caf-609-18.doc dismissed for default on 05.09.2013. He further submits that Civil Application (St.) No. 13357 of 2017 was filed for restoration of First Appeal. However, the said application was dismissed on 22.09.2017 for want of removal of office objections and thereafter, the present application is filed for restoration of Civil Application (St. ) No. 13357 of 2017. There is delay in filing the present application. He further submits that the applicant will remove the office objections within a period of three weeks from today, hence the Civil Application be restored and the delay be condoned. 4.

It appears that Civil Application (St.) No. 13357 of 2017 was dismissed before issuance of notice on the other side. In view of the above submission, Civil Application is allowed in terms of prayer clause (a) and (b). If the objections are not removed within the stipulated time, the Civil Application will be dismissed without referring to the Court.
