The contention is that the crematorium is sought to be constructed in the restricted/prohibited zone. 2.

The learned AGP submits that the Petitioner has already approached the Maharashtra State Human Rights Commission. The Commission has already taken cognizance of the complaint of the Petitioner.

Mr.Thorat, the learned counsel for the Petitioner submits that the reply is filed before Committee but no further steps are undertaken. The Respondent-Authorities are also not N.S. Kamble page 1 of 2

As the Petitioner has already approached the Maharashtra State Human Rights Commission. At this stage, we are not inclined to entertain the Petition. The Petitioner may prosecute the proceedings with the Maharashtra State Human Rights Commission. Depending upon the decision of the Maharashtra Human Rights Commission, the Petitioner may take further steps.

In that event, all contentions of the Petitioners are kept open.
