Not on board. Upon mentioning, taken on board. The counsel for the respondent, on instructions, gives an undertaking that the respondent will bring back into the Court a sum of Rs.50,00,000/- which they have been permitted to withdraw as mentioned in paragraph 2 of the order dated 5th February 2015 passed by the Appellate Court as when directed. The undertaking is accepted. The counsel also, on instructions, states that an undertaking signed by the Managing Director of the Shraddha Talekar PA 1/2

9.cra.84.2015.doc respondent together with the Resolution authorizing the Managing Director to give an undertaking will be filed in the Small Causes Court on or before 2nd March 2015.

As regards paragraph 3 of the impugned order, the counsel for the applicant, on instructions, undertakes to deposit the amount in the Small Causes Court registry within three weeks from today. The undertaking is accepted.

The civil revision application stands disposed. As the civil revision application is disposed, the civil application does not survive and stands disposed accordingly.
