When this petition was placed before us, Mr. Jetly appearing for respondent nos. 1 to 3 states that there are instructions received from respondent nos. 1 to 3 to the effect that the fifth respondent to the writ petition has since issued the Export Obligation Discharge Certificate. Once that is issued, respondent nos. 1 to 3 would release the bank guarantee within a period of two weeks from today.

In the light of these statements made on instructions by Mr.Jetly, which are accepted as undertakings given to this court, we do not see any apprehension of the petitioner now surviving. Now the Branch Manager of the sixth respondent-bank will not be called upon to honour the bank guarantee.
