This is the second bail application filed by the Applicant mainly on the ground of delay in trial.

Learned APP had made a statement that the trial was delayed in view of the application filed by the Applicant not to frame charge. Mr. Mohan Salavi, PSI has filed his affidavit. A perusal of the same indicates that the discharge application filed by the Applicant was rejected on 02/05/2022. Thereafter the Applicant filed application before the Trial Court not to frame charge. Said application was rejected on 18/08/2022. Subsequently, the Applicant sought adjournment on several dates, which have been mentioned in the order 1/2
Megha 26_ba_609_2022.doc of the Trial Court. It appears that the Applicant himself is responsible for delaying the trial. Hence, the Applicant cannot claim bail on the ground of delay in trial. Hence, the bail application is rejected. However, considering the fact that the Applicant is in custody since last 5 years, the Trial Court is directed to decide the matter expeditiously, in any case to conclude the trial within a period of 10 months from the date of receipt of copy of this order.
