After this petition was heard for some time, learned counsel for the Petitioner seeks leave to withdraw this petition with liberty to file a fresh application, objecting to the territorial jurisdiction of the learned Judicial Magistrate, First Class, Sinner to entertain the complaint of the Respondent under Section 12 of the Protection of Women from Domestic Violence Act, 2005. In view of the withdrawal of the petition, the impugned order dated 30.01.2018 itself should be rendered inconsequential. The petition is accordingly allowed to be withdrawn with liberty as prayed for.

All contentions of the parties on merits are expressly kept open.
