DATE : JUNE 22, 2022.

P.C. :

1.

The petitioners in this writ petition dated February 7, 2019 have laid a challenge to paragraph 92 of the order dated December 21, 2018 passed by the Central Administrative Tribunal, Mumbai Bench, Mumbai while dismissing several original applications which were before it. 2.

It is not in dispute that the petitioners were not parties to the proceedings before the Tribunal; hence, we hold this writ petition to be not maintainable in view of the

14.wp.2929-19.doc decisions of the Supreme Court reported in (1997) 6 SCC 473 (K. Ajit Babu and others vs. Union Of India and others) and (2007) 14 SCC 54 (Rama Rao and others vs. M.G. Maheshwara Rao and others). Incidentally, a coordinate bench of this court followed the said decisions in its decision in Writ Petition No. 7520 of 2019, and we share the view taken therein.

3.

The writ petition, accordingly, stands dismissed. There shall be no order as to costs.

4.

This order shall not preclude the petitioners to explore their remedies elsewhere in accordance with law. (M. S. KARNIK, J.) (CHIEF JUSTICE)
