This is an application for suspension of sentence and releasing the applicant / accused on bail during pendency of the appeal filed by him.

Heard both sides.

7-APPA-234-2017.doc The applicant / accused has been convicted of the offence punishable under Section 498A of the IPC and he has been sentenced to suffer rigorous imprisonment for 2 years and to pay a fine of Rs.1,000/-, in default, to undergo simple imprisonment for one month. The substantive sentence of imprisonment imposed upon the applicant / accused is already suspended by the learned trial court. Short sentence is imposed on the applicant / accused and the offence allegedly proved is one under Section 498A of the IPC.

In this view of the matter, the following order : i) The application is allowed to the extent of suspension of sentence imposed upon the applicant / accused by the learned trial court. ii) The applicant / accused is directed to be released on bail on his executing P.R.Bond in the sum of Rs.15,000/- and on furnishing surety in like amount.

iii)Parties to act on an authenticated copy of this order.
