Mr. Rao, learned Counsel appearing in support of the petition, on instructions, seeks to withdraw this petition with liberty to approach the Commissioner of Income Tax (Appeals) [CIT(A)] for the early hearing on its appeal from the order dated 30th March, 2013 relating to Assessment Year 2008-09. Liberty as sought for is granted. 2.

Needless to state the CIT(A) will consider the application, if any, made by the petitioner on its own merits.
