After arguing the application for some time and when the Court was not inclined to grant any relief, learned advocate for the Applicant, on instructions, submitted that the Applicant may be permitted to withdraw this application. However, it is submitted that the Applicant is in custody from 19th September 2016 and hence trial may be expedited. It is submitted that main charge levelled against the Applicant is under Section 420 of Indian Penal Code. It is submitted that as far as charge under Section 376 of IPC is concerned, it was consensual relationship. It is, therefore, submitted that in view of that, trial may be directed to be concluded expeditiously. 2.
The application is allowed to be withdrawn and dismissed as such. However, the Trial Court is directed to conclude the trial expeditiously within a period of nine months. (PRAKASH D. NAIK, J.) MST
