Applicant/Original Claimant in Motor Accident Claim Petition No.59 of 2006 seeks leave to withdraw the amount deposited by the Maharashtra State Road Transport Corporation (appellant) in pursuant to award passed in M.A.C.P. No.59 of 2006 by the Motor Shivgan 1/2

21-IA-306-22.odt Accident Claims Tribunal, Islampur.

Considering the averments in the application and particularly, that the accident had occurred in March, 2000, applicant is permitted to withdraw part of the amount. The Tribunal shall disburse the sum of Rs.2 Lakhs to the applicant without security and the balance amount will be re-invested in a nationalised bank initially for a period of two years to be renewed thereafter pending the final hearing of the First Appeal.

Interim Application is allowed and disposed of in aforesaid terms.
