Heard learned counsel for applicant and learned APP. This application is for modification of condition imposed by Trial Court by its order dated 15.1.2019. Perusal of said order would reveal thus: "Condition of depositing cash security Rupees Two Crores imposed on all applicants in four applications is relaxed and modified as prayed in applications".

Considering the order as aforesaid specific query was put to learned counsel to state what was prayer made to which attention is - Page-1/2

Nalawade 915-appp-67-19.doc invited to last paragraph of application dated 6.12.2018 which reads thus:

"Thus, in the circumstances narrated above, it is submitted that, the condition of bail in Cri. Misc. Application No.1267/2018 may kindly be modified and reduced to suit the middle class status of the present applicant, and for this act of kindness the applicant shall pray forever".

After considering the prayer made and the order passed by learned Additional Sessions Judge, Nashik it is difficult to find as to what is amount of cash security ordered by trial court. In that view of the matter, application stands disposed off as dismissed with liberty to applicant to file a fresh application after applicant adopts recourse by approaching trial court by filing application for speaking to minutes and get clarification with regards to amount of which cash security is to be given on condition prescribed.
