After addressing the Court for some time, the learned counsels submitted in unison, that since the registration of the motion at Exhs. P and P-1 of the petition is rejected at the threshold, with consent of the parties, the order impugned can be set aside and substituted by the following arrangement:- 1.

The impugned order is set aside.

The draft notice of motion at Exhs.P and P-1 to the petition be registered.

On the next date of hearing i.e., 04.07.2022 the respondents shall file reply to the notice of motion. A. A. Mudaliyar page 1 of 2

Counter, if any shall be filed within the next seven days.

The learned City Civil Court shall decide the notice of motion on merits after hearing every stakeholder as expeditiously as possible and in any event within three weeks from the completion of pleadings.

Petition is disposed of in terms of the aforesaid consent arrangement.

Needless to observe, every contention raised by the petitioners or by the respondents is expressly kept open. 2.

At this stage the order dated 01.03.2014 of the City Civil Court is brought to my notice whereby the suit is expedited, and was to be decided within six months. In view of the earlier order of the City Civil Court, I request the learned Judge to expedite the hearing of the suit.
