At the outset, learned A.P.P states that the applicant has filed an application seeking his enlargement on bail in the Sessions Court in 2016, being Criminal Bail Application No. 2176 of 2016. He submits that despite the fact, that the said application is pending before the learned Sessions Judge, the present application has been filed in this Court. 2.

In view of the statement made by the learned A.P.P, learned Counsel for the applicant seeks leave to withdraw this application. He SQ Pathan 1/2

ba.394.17.11.doc states that the applicant will pursue the application filed in the Sessions Court i.e. Criminal Application No. 2176 of 2016. 3.

Accordingly, the application is disposed of as withdrawn. 4.

The learned Sessions Judge, shall decide Criminal Bail Application No. 2167 of 2016, pending before him, on its own merits, uninfluenced by the withdrawal of this application. It is made clear, that this application has not been heard on merits. REVATI MOHITE DERE, J.
