After arguing for some time, Mr. Ponda, learned counsel for the Applicant, states that the Applicant will not press this Criminal Application, provided the Criminal Appeal No.131 of 2016 is heard expeditiously.

Mr. Yagnik, learned A.P.P. for the Respondent-State, states that he has no objection for expeditious hearing of Criminal Appeal No.131 of 2016, filed by the Applicant-Appellant. APPA-209-16.doc

In the above circumstances, we are inclined to allow the Applicant to withdraw this Criminal Application. Ordered accordingly.

We, simultaneously, direct the Registry to place Criminal Appeal No.131 of 2016 on the 'Final Hearing Board' in the week commencing from 10th April 2017, to be placed 'High on Board'. The Applicant-Appellant shall file private paper-book within a period of four weeks from today.

In case Criminal Appeal No.131 of 2016 is not heard within a period of six months from today, the Applicant-Appellant is entitled to renew his prayer for bail.
