1) Heard. Applicants herein are seeking transit bail in crime no. 248 of 2013 registered at Nacharam Police Station District Cyberabad wherein they are accused for having committed offence under sections 406, 420, 447, 385, 386, 467, 468, 469, 471, 120 (B) r/w 34 of the Indian Penal Code. 2) The learned counsel for the applicants submits that initially they had received notice from the said police station and that they had attended the said police station and co-operated with the investigating agency. Thereafter, applicants were not in receipt of any bailable or non-bailable warrant. It is submitted upon instructions by the learned counsel for the applicants that one of the co-accused who was similarly placed, Mr. Mukesh Chavan was arrested by the Economic Offence Wing (E.O.W.) with the aid of Mumbai police and therefore, applicants are also apprehending arrest. The learned counsel for the applicants submits that applicants desire to approach the police station and co-
4 915.280.17 aba operate with the investigating agency or file appropriate proceedings as advised.
3) In view of this, applicants deserve transit bail, without going into the merits of the matter.
O R D E R
(i) Applications are allowed.
(ii) In the event of arrest in crime no. 248 of 2013 registered at Nacharam Police Station, District Cyberabad and being investigated by Economic Offence Wing, applicants be enlarged on bail on furnishing P.R. bond in the sum of Rs. 25,000/- each with one or more sureties in the like amount for a period of three weeks from today.
(iii) At the end of 3 weeks i.e. on 26/03/2017, protection would be deemed to be vacated.
(iv) Applications are disposed of accordingly.
