This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No.306 of 2022 registered at Chikli Police Station, Pimpri-Chinchwad for the ofences punishable under Sections 323, 326 and 504 read with 34 of the Indian Penal Code.

According to the prosecution, on the date of incident, which took place on 17 June 2022, the present applicant and other coaccused assaulted the complainant by knife etc. as he refused to give them money to consume liquor.

The main allegations are against the co-accused Aslam Mujawar. The learned counsel for the applicant, on instructions, submits that pursuant to the order passed by this Court, the applicant without prejudice to his rights had handed over the Dinesh S. Sherla 1/2

15-aba-447-23.doc amount of Rs.25000/- to the Investigating Ofcer towards medical expenses of the complainant. Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No. 306 of 2022 registered at Chikli Police Station, Pimpri-Chinchwad for the ofences punishable under Sections 323, 326 and 504 read with 34 of the Indian Penal Code, he be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C) The applicant shall attend the concerned police station as and when called by the Investigating Ofcer and shall cooperate in the investigation.
